These Terms & Conditions govern the purchase of products from SOLMAR PARTNERS S.L. (trading as Goody Candy) through the Website https://www.goodycandy.com/.

By placing an order, you agree to be bound by these Terms & Conditions, our Privacy Policy and our Shipping & Returns Policy.

We are registered with the relevant food control and environmental authorities for the handling and sale of food products.


2. How to Place an Order

Browsing and selecting products

You can browse our products by category or use the search bar at the top of the Website. Click on a product to view detailed information, including ingredients, best before dates and pricing.

Adding items to your cart

To purchase a product, click "Add to Cart". You can continue shopping or proceed to checkout by clicking the bag icon in the upper-right corner.

Checkout process

At checkout, you will be asked to:

  1. Provide or confirm your delivery address
  2. Select a shipping method
  3. Choose a payment method
  4. Review your order summary

Once you confirm your order and complete payment, you will receive an order confirmation email with your order number and details.


3. Contract Formation

A binding contract is formed when:

  1. You place an order through the Website
  2. We accept your order by sending you an order confirmation email

We reserve the right to refuse or cancel an order in the following cases:

  • The product is out of stock
  • Pricing or product information is incorrect due to a technical error
  • We are unable to process payment
  • We suspect fraudulent activity

If your order is cancelled after payment, you will receive a full refund.


4. Prices and Payment

Prices

All prices displayed on the Website are in Euros (€) and include applicable VAT, in accordance with EU regulations.

We reserve the right to change prices at any time. However, changes will not affect orders that have already been confirmed.

Payment methods

We accept the following payment methods:

  • Visa, Mastercard, Maestro
  • Apple Pay, Google Pay
  • Bizum (Spain only)

All payments are processed securely through Shopify Payments or the relevant payment provider. We do not store your full card details.

Payment is due at the time of order. We will only ship your order once payment has been successfully processed.


5. Shipping and Delivery

Full details are available in our Shipping & Returns Policy. Key points:

Delivery areas

We ship to Spain (mainland and Balearic Islands), Portugal (mainland), France, Germany, Netherlands, Belgium, Luxembourg, Austria and Italy.

We do not ship to the Canary Islands, Ceuta, Melilla or PO boxes.

Delivery times

Estimated delivery times after dispatch:

  • Spain (mainland) & Portugal (mainland): 1–2 business days
  • All other destinations: 2–4 business days

Shipping costs

  • Free shipping on orders over €50 to Spain and Portugal mainland
  • Flat rate for Spain and Portugal mainland under €50
  • For other destinations, costs are calculated based on delivery zone and order weight at checkout

Risk and ownership

Risk of loss or damage passes to you upon delivery. Ownership of products passes to you once we receive full payment.


6. Right of Withdrawal (Cancellation Policy)

Under EU consumer protection law, you have the right to cancel your order within 14 days of receiving the products, without giving a reason.

Important exception: Food products

In accordance with Article 16(e) of the EU Consumer Rights Directive (2011/83/EU), the right of withdrawal does not apply to perishable goods, including food products such as candy.

For this reason, we do not accept returns of food products once they have been delivered, unless the products are:

  • Incorrect
  • Damaged
  • Defective

If you receive an incorrect, damaged, or defective product, please contact us within 5 days of delivery. We will offer a replacement or refund, depending on the situation.

Return shipping costs

We cover return shipping costs only for incorrect, damaged or defective products. In all other cases, return costs are the responsibility of the customer.


7. Product Information and Availability

We make every effort to ensure that product descriptions, images and prices are accurate. However, errors may occur.

If we discover an error in the price or description of a product you have ordered, we will inform you as soon as possible and give you the option to:

  • Confirm the order at the correct price
  • Cancel the order and receive a full refund

Stock availability

All orders are subject to product availability. If a product becomes unavailable after you place an order, we will:

  • Remove the unavailable item from your order
  • Only charge you for the items that are shipped
  • Inform you by email

8. Customer Account

You may create an account to:

  • Save your delivery address and payment preferences
  • Track your orders
  • View your order history

You are responsible for keeping your account login details secure. Please notify us immediately if you suspect unauthorized access to your account.

To the fullest extent permitted by law:

  • We are not liable for delays or failures in delivery caused by events beyond our reasonable control (force majeure), including but not limited to strikes, natural disasters, or carrier delays
  • We are not liable for indirect or consequential losses
  • Our total liability for any claim arising from your order is limited to the amount you paid for the products in question

This does not affect your statutory rights as a consumer.


11. Force Majeure

We are not liable for any failure or delay in fulfilling our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Strikes or labor disputes
  • Transport disruptions
  • Government restrictions
  • Technical failures

Any dispute arising from these Terms & Conditions or your purchase will be subject to the jurisdiction of the Courts of Málaga, Spain, unless applicable consumer protection laws provide otherwise (such as the courts of your country of residence).
